Under Florida law as it currently stands the licensee who holds the license to operate the skilled nursing facility is the proper entity to sue in a nursing home negligence or abuse case. There are circumstances where other persons or entities assume a duty toward the resident. Often times we have situations where the actual employees are leased from another agency. When somebody assumes a duty under Florida law, those folks can be held liable as well. The general fact is that it is the licensee, and only the licensee for the nursing home that is legally liable.
