Most cruise lines are pretty sophisticated. If you were to take some of the major cruise line carriers such as Norwegian, Carnival or Royal Caribbean, you’ll find that there is a ticket or a contract of carriage that is issued to each passenger who pays to go aboard the cruise. That ticket is very specific. It has in its small print – usually on page 24 – a forum selection clause that tells you specifically where your lawsuit needs to be filed. You can be injured aboard a cruise line vessel out of California and to your horror – nine months later when it is determined that you need to file a lawsuit – you find out that it has to be filed in the southern district court, the Federal Court Miami.
