Nursing homes are not medical providers under Florida law. Nursing home neglect and abuse case, nursing home negligence cases, virtually anything that arises in the context of a nursing home setting is brought under Chapter 400 Florida statute, which is the nursing home residents’ rights statute. Medical malpractice cases, in contrast, involve actions or inactions by medical providers, typically doctors or hospitals. It’s an entirely different area of law and it involves proving that the offending medical provider departed from the prevailing professional standard of care.
