Maintenance and cure is an old doctrine that flows back to the times when all of the commerce ran on the high seas. Basically, what maintenance and cure is is a form of maritime workers’ compensation insurance, but they don’t call it workers’ compensation. When I began practicing, the average maintenance award per day was $15. In other words, if you were a seaman and you were hurt aboard a ship and you were off work, the employer owed you $15 a day for your maintenance. You were supposed to be able to live on that. The cure aspect of it involves the medical bills and the medical expenses that your ship owner or your employer has to pay. In a current case, it appears that the maintenance amount is up to $64 a day. I think that’s a sign of the times. I’m not saying you can live on it.
