When someone dies from an injury, the injury that they sustained no longer is the focus. The focus becomes the wrongful death of the passenger who was aboard the cruise line. Wrongful death cases aboard cruise lines typically involve an interplay of federal law, and some state law may apply. To suggest that a state law wrongful death statute applies to a cruise line is probably an error in judgment. Because admiralty and maritime law is a creature of the Federal Court system, one has to look to the Federal Court system for the remedies. In short, you can bring a wrongful death action, but you need a competent, experienced lawyer to figure out the law under which that wrongful death action can be brought.
