A visitor to a nursing home would simply be an invitee on the premises. If someone comes to visit a nursing home resident, and that person who is not a resident slips and falls because there’s a substance on the floor, then that person who is the visitor and is the invitee on the premises has an action against the nursing home as a property owner, as a premises owner. A visitor coming to see a resident at a nursing home is not able to avail himself or herself of the remedies under the nursing home law. That situation would simply be a premises liability or direct negligence action.
