A bad outcome from a doctor doesn’t mean that there was medical negligence. Many people who have called me over the years are concerned about their bad outcome and think just because things didn’t come out as well as they hoped they were that the doctor must have done something wrong. In order to hold a doctor, a hospital, another medical provider responsible for a bad outcome, a plaintiff, a claimant still has to be able to prove that that doctor or medical provider departed from the reasonable and acceptable standard of care for a similarly situated physician under like circumstances. It is a very tough burden to meet and just having a horrendous injury doesn’t mean that a claimant or a plaintiff can prove medical malpractice.
