I would say that most people who have a nursing home negligence or abuse case do need a lawyer. The requirements of chapter 400 statutes, which is the nursing home residents’ rights and assisted living facilities residents’ rights statute is pretty complex. It’s not like filing a car crash case, which you might be able to handle yourself. The allegations are simply, “Hey, you hit me from behind.”

In nursing home cases, you have to be able to pinpoint violations of acceptable standards and federal standards and nursing standards in order to succeed either in pre-suit or in the courtroom. So, I would say that, in my opinion, somebody playing with a nursing home case without a lawyer is probably not going to get a very good recovery if they get a recovery at all.
