Witnesses are important in any personal injury case. Witnesses are even more important in nursing home cases. Many times we have no witnesses. The problem with nursing home and medical malpractice actions from the plaintiff’s lawyers perspective is they are the types of cases where your enemy, and I don’t mean that personally, but the adverse party gets to fill out all the records. You’re in a situation where your opponent gets to write everything that’s in the chart and often times what they put in the chart isn’t the truth. We get around this, we counter this, by having skilled medical experts take a look at the nursing home chart and make a determination, does this make sense? Could this notation actually be accurate and when you look at the patient’s entire history in the nursing home many times we find things that are false entries. That just aren’t supported by good medicine or good nursing home practice.
